Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MenuMingle marketing website at menumingle.com and related pages (the “Site”). Paid product access, onboarding, and restaurant operations are governed by your Order Form, Statement of Work, and any product-specific agreements with MenuMingle, Inc. (“MenuMingle,” “we,” “us,” or “our”). If those agreements conflict with these Terms for paid services, the signed commercial terms control.

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Who may use the Site

The Site is intended for restaurant operators, partners, and other business users. You represent that you are at least 18 years old and have authority to accept these Terms for yourself or the organization you represent.

2. The Site and our services

The Site provides information about MenuMingle, pricing overviews, educational content, and ways to request a demo or contact sales. Features, pricing, and roadmaps described on the Site may change and are not a commitment unless stated in a signed contract.

3. Demo and contact requests

When you submit a demo or contact form, you agree to provide accurate information and consent to MenuMingle contacting you about your request, including by email or phone, in accordance with our Privacy Policy.

4. Accounts and product use

Operator portal, diner experiences, and related products are subject to separate terms and acceptable-use rules. You are responsible for credentials issued to your organization and for content you upload (menus, media, branding). You must have the rights needed to use that content with MenuMingle.

5. Intellectual property

The Site, including text, design, logos, and software, is owned by MenuMingle or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Site except as expressly allowed in writing. Restaurant and dish imagery shown in marketing materials may depict pilot or example partners and remains subject to applicable rights.

6. Acceptable use

You agree not to:

• Use the Site in violation of law or third-party rights.
• Attempt to probe, scan, or disrupt the Site or related infrastructure.
• Scrape the Site in a way that overloads or harms our systems.
• Misrepresent your identity or affiliation when requesting a demo or contacting us.

7. Third-party links and services

The Site may link to third-party sites or tools (for example, scheduling or login portals). We are not responsible for third-party content, policies, or practices.

8. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUMINGLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENUMINGLE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

10. Indemnity

You will defend and indemnify MenuMingle against claims, damages, and expenses arising from your misuse of the Site or your violation of these Terms, except to the extent caused by our willful misconduct.

11. Governing law

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict of law rules. Courts located in Oregon will have exclusive jurisdiction over disputes arising from the Site, unless applicable law requires otherwise.

12. Changes

We may update these Terms by posting a revised version on this page with an updated “Last updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
